We strive to maintain continuous platform availability but do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or events beyond our control may result in temporary unavailability. We will make reasonable efforts to notify users in advance of planned downtime.

4.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

5. Subscriptions, Payments, and Refunds

5.1 Pricing and Billing

Certain features and content on the platform require payment. Prices are displayed in the currency applicable to your region at the time of purchase. All applicable taxes are the responsibility of the user unless otherwise stated. Prices are subject to change with reasonable prior notice.

5.2 Subscription Terms

To the maximum extent permitted by applicable law, Dovlase and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of data, loss of revenue, or loss of educational opportunity.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the total amount paid by you to Dovlase in the twelve months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Dovlase and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at support@bem-v7.com or through the account settings where available. Termination does not entitle you to a refund except as provided in our Refund Policy.

13.2 Termination by Us

We reserve the right to suspend or permanently terminate your account and access to the platform at our sole discretion, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or harmful behavior, or for any other reason we deem appropriate.

13.3 Effect of Termination

Upon termination, your license to use the platform and access to all content immediately ceases. Provisions of these Terms that by their nature should survive termination, including intellectual property rights, disclaimers, limitations of liability, and indemnification, shall remain in full force.

14. Governing Terms and Dispute Resolution

These Terms are governed by general principles of international commercial law, without regard to any specific jurisdiction's conflict of law provisions. If a dispute cannot be resolved informally within thirty days, either party may pursue resolution through binding arbitration conducted in English under internationally recognized arbitration rules. Nothing in this section prevents either party from seeking emergency injunctive relief where necessary to protect intellectual property or confidential information.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Language

These Terms are provided in English. In the event of any conflict between a translated version and the English version, the English version shall prevail.
